Brian Diamond represented a sixty seven year-old homemaker who had a heart attack and was taken to the emergency room, where a routine x-ray suggested a possible nodule on her lung and recommended follow-up. The finding was never mentioned to the patient, nor was there any follow-up, until lung cancer was discovered later. A major dispute developed in the case about whether follow-up would have made any difference, given the type of lung cancer involved. The case was settled after the start of trial and a number of motions had been heard by the Court. The case showed that the firm's attention to detail in preparing for trial and motion practice can often significantly impact the final results obtained for their clients.
